Make sense of your choices

Who should do each job?

These are responsibilities, not honorary titles.

The short version.

Trustee is trustworthy.

Your trustee follows the trust’s instructions, keeps records, and handles the duties attached to the role. Generally, the person you trust most in this world.

Handle the estate.

A personal representative administers the probate estate after the necessary appointment. Shouldn’t be necessary for assets properly held in your trust.

Help during your life.

A financial agent manages covered transactions. A patient advocate makes authorized healthcare decisions. Different people can fill these jobs.

A practical example.

More detail, if you want it.

Open the explanation and sources

A fiduciary has authority and duties defined by the document and law. The job is a responsibility, not an honor.

Separate the jobs

  • Trustee: manages trust property under its terms.
  • Personal representative: administers a probate estate after the necessary appointment.
  • Financial agent: acts within a power of attorney during the principal’s lifetime.
  • Patient advocate: makes authorized care decisions when the conditions for that authority are met.

Trustees may owe duties of loyalty, recordkeeping, administration, and reporting. Family status does not remove them. A financial power of attorney ends at death.

Ask practical questions

  • Will the person accept after understanding the work?
  • Can they keep records, meet deadlines and seek professional help?
  • Could geography, health, time or family conflict interfere?
  • Who takes over if the first choice cannot serve?

Prepare the person, not just the paperwork

Explain the assets, beneficiary needs, and document locations. Confirm willingness and backups. Different people can serve different roles.
